DMCA Policy

1. Overview

Casting Companion respects the intellectual property rights of others and expects users of the Platform to do the same. This policy describes our procedures for addressing claims of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

Casting Companion aggregates publicly available casting calls and also accepts direct submissions from casting directors. We take copyright claims seriously and will respond promptly to valid takedown notices.

2. Safe Harbor

Casting Companion operates as an online service provider within the meaning of the DMCA. We qualify for safe harbor protection under 17 U.S.C. § 512(c) because we:

  • Do not have actual knowledge of infringing material on our Platform
  • Act expeditiously to remove or disable access to infringing material upon notification
  • Have designated an agent to receive takedown notices (see Section 8)
  • Do not receive a direct financial benefit attributable to infringing activity
  • Maintain and enforce a repeat infringer policy

3. Filing a Takedown Notice

If you are a copyright owner or an authorized agent and believe that content on the Platform infringes your copyright, you may submit a DMCA takedown notice to our Designated Copyright Agent (see Section 8).

Upon receipt of a valid and complete DMCA notice, we will act expeditiously to remove or disable access to the allegedly infringing content and will notify the user who posted the content.

We will process takedown notices in the order received. Complex or incomplete notices may take additional time to review.

4. Takedown Notice Requirements

To be valid under the DMCA, your written takedown notice must include all of the following:

  • Identification of the copyrighted work — Describe the work you claim has been infringed, or provide a representative list if multiple works are at issue.
  • Identification of the infringing material — Provide a specific URL or sufficient information to locate the content on our Platform that you claim is infringing.
  • Your contact information — Include your full name, mailing address, telephone number, and email address.
  • Good faith statement — A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or applicable law.
  • Accuracy statement — A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.
  • Signature — Your physical or electronic signature.

Warning: Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material is infringing may be subject to liability for damages, including attorneys’ fees.

Notices that are incomplete, inaccurate, or fail to meet the above requirements may not be acted upon. We reserve the right to request additional information before processing a notice.

5. Counter-Notice Procedure

If you believe your content was removed as a result of a mistake or misidentification, you may submit a counter-notice to our Designated Agent. A valid counter-notice must include:

  • Your physical or electronic signature
  • Identification of the material removed and the URL where it appeared before removal
  • A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification
  • Your full name, mailing address, telephone number, and email address
  • A statement that you consent to the jurisdiction of the federal court in the judicial district where you reside (or, if outside the U.S., any judicial district where Casting Companion may be found) and that you will accept service of process from the person who filed the original notice

Upon receipt of a valid counter-notice, we will forward a copy to the original complainant. If the complainant does not file a court action within 10 business days, we may restore the removed content at our discretion.

6. Repeat Infringer Policy

In appropriate circumstances, Casting Companion will terminate the accounts of users who are determined to be repeat infringers. A user may be considered a repeat infringer if we receive multiple valid DMCA takedown notices identifying content posted by that user.

We will use reasonable judgment in applying this policy and reserve the right to terminate accounts at our discretion where we believe infringement is occurring.

7. Misuse of the DMCA Process

The DMCA takedown process is intended to protect legitimate copyright claims. We reserve the right to investigate and pursue legal remedies against parties who abuse the takedown process to suppress lawful content, interfere with competition, or harass users.

Filing a false or bad-faith DMCA notice may expose you to liability under 17 U.S.C. § 512(f) and other applicable law.

Please send DMCA notices only to the designated agent. Communications sent to other Casting Companion addresses may not receive a timely response and will not constitute valid DMCA notice.
